Where the pool can go
Under the zoning code, a private pool, including its aprons, walks and equipment, cannot protrude into a required side yard and cannot sit closer than eight feet to any lot line. It cannot go between the house and a side lot line. The pool is for the household and guests only, never a business or club.
The pool also counts toward accessory structure coverage. The zoning code caps attached and detached accessory structures at 40 percent of the rear yard, so a big patio, shed and pool on the same yard are added together.
Fence and barrier rules
Every inground or above ground pool must be fully enclosed by a fence. The zoning code allows it on the property line, at four to five feet high and of an open or semi open type, or inside the lot at least five feet from the property line at the same height. The village barrier checklist adds the details: at least 48 inches high all the way round, no gap under the fence over two inches on grass or four inches on concrete, and the fence at least three feet from pool equipment, furniture or landscape blocks.
Gates must self close, self latch and swing away from the pool, with child proof hardware at least 54 inches above grade. Doors from the house into the pool area need an audible alarm, and so do windows with sills under 48 inches. Standard chain link mesh at two and a quarter inches does not pass. Chain link must have openings no bigger than an inch and a quarter. Picket gaps must be under four inches.
Codes, permits and the order of work
Schaumburg reviews pools under the 2021 International Swimming Pool and Spa Code and the 2021 International Residential Code, both with local amendments. If the existing fence does not meet the barrier rules, you need a separate fence permit as well. The fence permit asks for a plat of survey and a string line between your corner markers for inspection.
The pool may not be filled above 24 inches, or used, until it has passed all pool and barrier inspections. J.U.L.I.E. must be called at least 48 hours before digging. If you have a sump pump or downspouts near the dig, any new drainage piping needs a land development permit.
Neighbours and HOAs
Many Schaumburg homes sit in associations, and the village asks for signed HOA approval for any exterior project. Get that approval before the design is final, because a pool layout that works for the village can still fail an association's fence or location rules.
